Victory – AB 713 Stopped!

Bill:  AB 713 (Weber) Mandatory Kindergarten

AB 713 has been stopped in the Senate Appropriations Committee.

We are thankful to God and for all who participated in winning this tremendous victory!

We have strongly opposed AB 713. Thank you for your important prayers and phone calls that played a key part in this victory!

The Senate Appropriations Committee did not vote to approve AB 713 by the deadline for passing bills out of committee this year. AB 713 cannot be acted on again until next year (2016).

AB 713 would mandate Kindergarten for all students before they can enter the first grade, adding another year of schooling before graduation.

AB 713 endangers children by both putting them in harms way of the negative effects of forced earlier entrance into formal education and by removing the current right of parents to protect their children from these dangers.

We at FPM and HSLDA invested a considerable amount of time, energy, and resources in stopping this bill. We worked to educate legislators and their staff on the dangers of AB 713. FPM’s Nathan Pierce led our “on the ground” opposition at the Capitol through meetings, testimony in committee hearings and distributing opposition letters. We appreciate the key role of CHEA and other organizations who worked to obtain this victory.

No further action is required on AB 713 this year.

New proposed legislation is now beginning to stream into our state capitol in Sacramento. This new 2-year legislative session for California began on December 1st. Already, California legislators have introduced 267 bills with hundreds more to come in the weeks ahead.

Family Protection Ministries (FPM) in partnership with HSLDA, is daily monitoring every piece of legislation introduced or amended throughout this 2015-2016 two-year session, as we have done in the past.  We identify and respond to any legislation that could affect private home schooling or any associated parental rights.

We at FPM are greatly blessed to have the outstanding expertise of Mike Smith and his team of attorneys at Home School Legal Defense Association (HSLDA) in providing detailed legal analysis of every bill that we have identified as potentially threatening to private home education.  After we (FPM and HSLDA) determine together the best strategic responses, we go into direct action and as needed, we contact you for your crucial help in contacting your elected legislators in Sacramento.

Although the growing liberal control in California can be discouraging and challenging, we are trusting that God will bless your prayers and support of our teamwork efforts to defend our home education freedoms from all attacks.

We are blessed to be able to continue our work in partnership with HSLDA and good people like you, as well as with CHEA (as their Legislative Consultant), and many other organizations and groups.  God has blessed us beyond measure by giving us success in protecting private home education from unnecessary government intrusion here in California for more than two decades.  We greatly appreciate the support of each of you through your vigilance, prayers, financial support, and contacting legislators (whenever we send out a Legislative Action Alert).

We continue to be firmly committed to working hard to preserve our God-given freedoms!

As we have been reminded by recent attacks from the media, the right to homeschool privately is a fragile thing in California and across the nation. Ignoring a wide range of sound research, some have complained that homeschooled students are lacking in good academic and life skills. There are those calling for new legislation to increase the regulation and accountability to public school officials.

We must remain vigilant to guard the freedoms, which God has entrusted to us.

Another Major Victory Protecting All Parents and Children in CA!

Bill: AB 1256 – Blocking Entry and Exit from facilities (including private schools and homes)

Author: Assembly Member Richard Bloom

 

Position: Strongly Opposed Unless Amended

 

Status: Positively amended before being signed into law.

 

A Great Victory for all Parents and Children!!

The author accepted all of the amendments presented to him by FPM. These amendments were researched and written in close teamwork with HSLDA.

Summary:

AB 1256 perfectly illustrates how a poorly written law can have detrimental unintended consequences. AB 1256 was written to protect the children of celebrities in situations where paparazzi blocked children from reaching their parents while being picked up from school.

However, AB 1256 would have, among other things, made it unlawful for any person to interfere with any person attempting to enter or exit their private home, private school, church, and other facilities.

While the reprehensible behavior of paparazzi needed to be addressed, the overbroad language would have failed to distinguish: (1) between “the bad guys”and “the good guys” and (2) between interference that is bad and interference that is good and necessary!

This overbroad language, which included definitions of “blocking”, “interfering”, and “facility” – would have effectively made it illegal for you to block someone you thought was a threat from entering your home or other facility without your permission, including any school, church, or other facility (for which you had responsibilities to help protect its occupants) and would have made you subject to civil lawsuits and civil penalties.

For example, if the victim of a home invasion blocks his doorway to prevent an uninvited intruder from getting into his home, then AB 1256 (before our amendments were accepted) would have allowed that home intruder to sue the resident for getting in the way. The resident would have been subject to a civil lawsuit and a civil penalty, with fines up to $15,000. Such a situation seems outrageously ridiculous, but such was the case with the broad definitions and language used in early versions of AB 1256.

These problems with the bill were fixed with our following two amendments:

(1) Our first amendment removed “private residence” from the definition of a facility.

(2) Our second amendment stated that the new law “shall not be construed to restrict, inhibit, prevent, or bring a chilling effect upon any actions by a person that are reasonable under the circumstances to protect, secure, provide safety to, or prevent illness in any child or adult in a facility.”

Filing the Private School Affidavit (October 1st – 15th)

Every year the Private School Affidavit (PSA) must be filed between October 1st and 15th. If you are enrolled in a Private School Satellite Program (PSP), the school’s administrator files one affidavit for the whole group.

The Private School Affidavit (PSA) is now available on the California Department of Education’s web site at www.cde.ca.gov/sp/ps/rq/affidavit.asp. Private schools, including single-family home-based schools (homeschoolers), can proceed to file their affidavits.

We have reviewed the affidavit in consultation with HSLDA and it appears to be essentially the same as last year. The only change was that question #16 was changed from relating to school classification to a question about special education services. This question can just be left at the default answer “no”.

Bill:  AB 1444 as amended April 22, 2014 – Mandatory Kindergarten

Position: We Strongly Opposed.

Status: VETOED By Governor Brown – A Great Victory for Children and their Parents!!

It is with grateful hearts and thanksgiving to God that we received news that Governor Brown vetoed AB 1444 yesterday. This is truly an answer to prayer.

FPM’s Nathan Pierce testified in opposition to AB 1444 and worked toward this victory at the Capitol in your behalf.

We appreciate all who helped with your vital phone calls and prayers, and with teamwork support of our (FPM’s) work at the Capitol in Sacramento.

Summary of Concern:

AB 1444 would have encroached upon parental rights by making kindergarten mandatory before taking the first grade, forcing the addition of one more year to a child’s education.

No further action is required on AB 1444.

To the Members of the California State Assembly:

I am returning Assembly Bill 1444 without my signature.

This measure makes kindergarten compulsory by requiring all students to attend one year of kindergarten before entering first grade.

Most children already attend kindergarten, and those that don’t may be enrolled in other educational or developmental programs that are deemed more appropriate for them by their families.

I would prefer to let parents determine what is best for their children, rather than mandate an entirely new grade level.
