Legislative Update

The California Legislature has been working frantically to write and rewrite a myriad of bills.  We are continuing to work hard to evaluate hundreds of bills to see if they would affect private homeschooling and parental rights in California.

We continue to strongly oppose and closely watch AB 713 (Mandatory Kindergarten).  Last year, AB 713 failed to pass and was put on hold.  It is unlikely that AB 713 will move forward before this summer, but it could happen at any time. No action is needed now. For more information, see our last action alert on AB 713.

California Legislature: New Bills Pouring In

New legislative proposals are beginning to pour in for the 2016 California legislative year, which began January 4th.

In partnership with Home School Legal Defense Association (HSLDA), Family Protection Ministries (FPM) continues to daily monitor every piece of legislation introduced or amended throughout this 2015-2016 two-year session.  Working together, we respond to any legislation that could affect private home schooling or any associated parental rights.

We continue to strongly oppose and closely watch AB 713 (Mandatory Kindergarten).   AB 713 worked its way through the California State Legislature to the Senate Appropriations Committee, where it failed to pass and was put on hold last year.  AB 713 would need to be approved by the Appropriations Committee and then by the whole State Senate before going to Governor Brown for his signature.  Based on previous bills in this situation, it is unlikely that AB 713 will move forward before this summer, but it could happen at any time.  No action is needed now.  We will send out an email Action Alert just as soon as AB 713 starts to move forward again.  It is critical that this bill be defeated.  For more information about AB 713, see our last action alert on AB 713.

FPM and HSLDA work together to identify potentially threatening legislation that could impact the freedom of private home education in California.  We closely analyze every bill we have identified as troublesome.  After we have determined the best strategy, we go into action.  As needed, we contact you through our email Alerts and websites, asking for your crucial help in contacting your state legislator.

It is critical that we continue to be as vigilant as ever in California.  The liberal control of California state government can be discouraging and challenging.  But we know that, as God has done in the past, He will bless your prayers, support, and calls to your state legislators.  It is a privilege to work in teamwork with you and with CHEA and other organizations to preserve our freedoms.

California Department of Education Lawsuit Raises Questions about Student Records

Dear Friends of HSLDA:

A recent post on the California Department of Education’s website about a lawsuit has concerned parents around the state.

Entitled “Notice of Disclosure of Student Records,” the post http://www.cde.ca.gov/re/di/ws/morganhillcase.asp reveals that due to a lawsuit filed several years ago by associations representing parents of children with disabilities, the department has been ordered to disclose certain information from its database. Specifically, the department will send personal information on some students to the associations, including information about children with disabilities, children who requested an assessment or who were assessed for special education eligibility, and children who are attending or have attended a California school at any time since January 1, 2008.

The federal court overseeing the lawsuit has already issued a protective order that prevents either party from disclosing any of this personal information to the public or using it for any purpose other than the lawsuit, and requiring all the information to be either returned to the department or destroyed after the suit is done. Additionally, it appears that the department will be using pseudonyms to protect all of the students’ and schools’ information. The federal court required the department to post a notice on its website informing parents of their right to object to the department releasing any information on their children.

For families who have homeschooled their children every year and have never requested a special education assessment, the department will not have any personal information on your children because the affidavit that is filed with the CDE does not have that information.

If you have had children in a California school during the time period involved, and you choose to object to the possible disclosure of information about your children, before April 1, 2016 you can either fill out the form found here http://www.cde.ca.gov/re/di/ws/morganhillcase.asp and mail it in, or you can mail a confidential letter to the judge handling the case. Since the letter must contain very specific information, you should read the instructions carefully if you choose to do a personal letter rather than a form.

Time to File Your Private School Affidavit

Filing the Private School Affidavit (October 1st – 15th)

Every year the Private School Affidavit (PSA) must be filed between October 1st and 15th. If you are enrolled in a Private School Satellite Program (PSP), the school’s administrator files one affidavit for the whole group.

The Private School Affidavit (PSA) is now available on the California Department of Education’s web site at www.cde.ca.gov/sp/ps/rq/affidavit.asp. Private schools, including single-family home-based schools (homeschoolers), can proceed to file their affidavits.

We have reviewed the affidavit in consultation with HSLDA and it appears to be essentially the same as last year.

We urge you to join HSLDA or renew your membership today. Victory – AB 713 Stopped!

JOINT LEGISLATIVE NEWSFLASH – September 3, 2015

Bill:  AB 713 (Weber) Mandatory Kindergarten

AB 713 has been stopped in the Senate Appropriations Committee.

We are thankful to God and for all who participated in winning this tremendous victory!

We have strongly opposed AB 713. Thank you for your important prayers and phone calls that played a key part in this victory!

The Senate Appropriations Committee did not vote to approve AB 713 by the deadline for passing bills out of committee this year. AB 713 cannot be acted on again until next year (2016).

AB 713 would mandate Kindergarten for all students before they can enter the first grade, adding another year of schooling before graduation.

AB 713 endangers children by both putting them in harms way of the negative effects of forced earlier entrance into formal education and by removing the current right of parents to protect their children from these dangers.

We at FPM and HSLDA invested a considerable amount of time, energy, and resources in stopping this bill. We worked to educate legislators and their staff on the dangers of AB 713. FPM’s Nathan Pierce led our “on the ground” opposition at the Capitol through meetings, testimony in committee hearings and distributing opposition letters. We appreciate the key role of CHEA and other organizations who worked to obtain this victory.

No further action is required on AB 713 this year.

AB 713 Alert Update

JOINT LEGISLATIVE Alert Update – July 15th, 2015

Bill:  AB 713 (as recently amended) – Mandatory Kindergarten
Author:  State Assembly Member Weber

Position: Strongly OPPOSE

AB 713, the mandatory Kindergarten bill, was heard in the Senate Education Committee on Wednesday, July 8th and passed with a 7-2 vote. The Legislature will begin their Summer Recess on Friday, July 17th.

After they return August 17th from their recess, AB 713 will be scheduled to be heard in the Senate Appropriations Committee by the end of August.

We will alert you when to take the next action against this bill.
